Elizabeth, it might help if I could understand why you want to contact the bank now about the fees. How has the situation changed? Have you acquired new information about something? If you can share some details, I would be happy to see if I can recommend any action for you.

I'm terribly sorry, Elizabeth. I must have missed your reference to the class action lawsuit in your initial post. If you have received official notification of the amount of your personal share of the settlement amount, then you will find it either deposited into your account or, if you no longer have an active account, a check will be mailed to the last address of record with the bank. I do know quite a number of people who have received their deposits but do not have access to any status of the mailed checks. As for who is "in charge," there is no single person in charge of processing these refunds. The funds are being dispersed by the system as information is entered. On your official notification, there should be contact information for followup questions. That would be a far better source that this area as we cannot speak for the bank officially -- only those associates contacted through official lines can speak officially on any topic. Here at Directly.com, we try to assist customers with general banking questions or situations. We are not allowed to speak to specific accounts as that would be a direct violation of the Bank of America Privacy Policy and we could lose our jobs or be sued. I wish you the best of luck and also wish you happy holidays. I would like to suggest that caps lock be avoided in this situations as "yelling" at someone who is attempting to assist you is generally counterproductive.

Thank you for your time and consideration, but here is a number to claims administrator Mr. Painter-1-612-359-2060-Claims Administrator. The total amount I was over charged was approximately $1592.00 on 2 accounts. Now heres the
"small print"--we only get 007.19% right around there. I got $129.13 total for all the money I was cheated out of, but yet, the money that is left over after paying all customers is going to be donated to education so BofA can get a tax credit. I am so upset and will be a "wart on their nose", until I get what they owe me. This is totally wrong, I want all the money they owe me!!!!!

Believe me when I tell you I absolutely understand your frustration and anger over this whole matter. Sadly, for the actual customers, the reimbursement percentage was negotiated between the attorneys that represented the customers and the bank's attorneys with the court approving the agreement before issuing the decision. No one gets more than that percentage and, because you agreed to be part of the class action suit and not reserve the right to pursue your own legal rights, that binds you to the agreement that was reached. As an associate, I had my own share of these fees and, while it won't make you feel much better, I know, I got zero back -- I worked for them and wasn't allowed the same "rights" to exercise if I wanted to keep my job. Again, I do know why you're upset and do understand what you're saying about the percentage but there's nowhere to go on this -- unless you want to contact the attorneys that made the killing on this lawsuit. To be frank, they were the only winners here. I'm sorry, Elizabeth, really sorry.

SO TRUE IT WAS THE ATTORNEYS WHO MADE THE KILLING ON THIS LAWSUIT AND I'M SURE BANK OF AMERICAS WILL GET THEIR TAX WRITE OFF SOMEWHERE ALONG THE "BOTTOM LINE", WELL, I'M NOT LETTING THIS GO, I AM GOING TO MAKE THE BIGGEST STINK ABOUT THIS UNFAIR LAW SUIT AND THE ORDER WILL BE SMELT ANYWHERE I SEND COMP[LAINT TO AND STARTING WITH CONSUMER PROTECTION. FORTUNATELY, I STILL HAVE MY BANK STATEMENTS FROM FROM THE YEARS WHERE I RECEIVED THE MOST FEES. I AM SO TIRED OF THE LITTLE GUY GETTING SCREWED. NO WONDER THE LAWYERS AND WHOMEVER WAS HADNDLING THE PR MESSAGES ABOUT THE SUIT WERE SO WILLING TO DO IT ALL AND NOT CAUSE THE CONSUMER ANY PROBLEMS, "YOU DON'T HAVE TO DO ANYTHING, IF YOU WANT TO BE A PART OF LAWSUIT, WE WILL HANDLE IT ALL SAID THE CAT TO THE MOUSE, AND WE GOT EATEN UP WITH FEES AND THE LAWYERS COLLECTED AND CAME OUT LIKE FAT CATS!!! THIS IS SO UNFAIR AND THESE LAWYERS SHOULD BE ASHAMED OF THEMSELVES. OH WELL, LIVE AND LEARN AND READ BETWEEN THE LINES!!! THANK YOU FOR YOUR RESPONSE, I WILL KEEP IN TOUCH ABOUT MY PLAN TO GET MY MONEY BACK THROUGH THICK OR THIN. LIZ
      HAPY HOLIDAYS AND GOD BLESS!!!

Good luck to you, Liz, and I definitely hope to near you found a way to get every penny back!

    Elizabeth,

Definitely understand your frustration with the overdraft fees. Unfortunately, if the last fees were assessed to your account in 2011 there will not be anything BOFA will do to reverse. When you have a fee or charge on your account which you would like to dispute, you must bring it to the bank's attention, typically within 90 days.

    Sorry!

I was part of the law suit due to the fact that I have been a loyal customer since the day bofa changed their name to bank of americaand was a customer in 2001 to present day. So this has been and on going issue and finally stopeed about january 2012. I did complain since the very first time I noticed their practice on overdraft fees and I sewnt emails faxes and letters to bank of america ceo and to the organization who oversees bank activities and investigate issues such as this. THANK YOU FOR YOUR TIME GOD BLESS AND HAPPY HOLIDAYS.

THIS HAS NOTHING TO DO WITH CURRENT CHARGES, THESE ARE THE CHARGES I WAS OWED THROUGH THE BOFA OVERDRAFT SETTLEMENT. I AM WELL AWARE OF BOFA'S PROCEDURE, BELIEVE ME, I FOUGHT THEM ON THESE OVER DRAFT FEES FOR 6 YEARS AND FILED NUMBEROUS COMPLAINTS WITH THE FEDERAL DEPARTMENT THAT OVERSEES BANK DISCREPENCIES. AS YOU ARE AWARE IN 2011 THE SETTLEMENT WAS APPROVED AND BANK CUSTOMERS WERE SUPPOSED GET ALL MONIES OWED TO THEM. I WAS OWED APPROXIMATELY $600 IF NOT MORE. SO AGAIN I ASK WHO OVERSEES THE SETTLEMENT AND WHO IS IN CHARGE OF DISBURSING THE MONEY OWED TO BOFA CUSTOMERS FOR THE SETTLEMENT OF THE LAW SUIT!!!!!!!!!??????? WHEN IT WAS SETTLED AND CUSTOMERS LIKE MYSELF WERE OVER CHARGED BANK FEES WE WERE OWED REFUNDDS SO PLEASE GET ME THE CORRECT ANSWER!!!!!!!!!!
  • Superme

I am superme, and I work at BoA. I know the bank inside and out.

Elizabeth, I had never met a customer who have got the full amount of fees back. In fact most people I see that get the settlement rebates have a check for 1.50 or 3.23.
It is true that BoA had a million dollar settlement but the funds were disperse so widely. To my understanding, you are wanting to contact someone in charge of disbursement?

    Please let me now.

Where there is a will, there is a way. I just won't accept their process of payment. I can understand the lawyers have to get paid, but I can't accept that all the money that is going to be left over will not go to those who actually lost so much. I lost approximately $1592 according the claims administrator, Mr. Painter. 7% is not acceptable. I can see them taking a third of what I am owed, even half, but insulting me with $129 is unacceptable and all I can do is try to get more back since I never signed any document stating I would accept 007.19%. Not even the check itself states that if I cash the check I am accepting their amount. Anyway, money talks so I might not get anymore but I will make it known how unfair and insulting the paymnet is. happy holidays and God Bless.
